The Sartin Law Firm, P.C. represents business and individual clients whom have experienced debt collection issues. Our approach to debt collection is to maximize recovery for the client, while minimizing the cost to obtain that recovery. We keep the client informed and up to date on the actions we are taking in each matter. The firm is committed to assisting its clients with commercial and consumer debt matters through aggressive negotiations and available judicial methods.
We accept cases on either: 1) a contingent fee arrangement, wherein we receive a percentage of all funds collected for the client; OR 2) a fixed fee arrangement, wherein the client pays one flat fee per debt, and keeps all funds collected by the firm. We handle matters all over the State of Texas.
Upon receipt and review of an account, we immediately issue a demand letter and undertake non-judicial collection activity for a period of sixty to ninety days. Non-judicial methods commonly include demand letters, negotiating with the debtor, foreclosures, repossession, or use of mediation and arbitration assistance. If the initial activity is unsuccessful in resolving the account, we will review the account to determine if circumstances warrant judicial activity or the filing of suit, or additional non-judicial activity. The decision is then made by the client whether to proceed with judicial collection.
Judicial collection methods commonly include collection litigation, the enforcement of judgments, both Texas and foreign, as well as pre-judgment attachments, garnishment, deficiency suits, injunctive relief, writs of execution, and post-judgment discovery methods.
The firm represents creditors in litigation involving delinquent commercial and consumer loans, promissory notes, failure to pay for goods or services, lease agreements, accounts receivable, and other bad debts.
The firm represents clients from outside of Texas in efforts to enforce and collection judgments entered in sister states pursuant to the Uniform Enforcement of Foreign Judgments Act (UEFJA).
Our knowledge of Texas collection laws, including the Texas Debt Collections Act, the Federal Fair Debt Collection Practices Act (FDCPA), the Texas Deceptive Trade Practices - Consumer Protection Act (DTPA), the Fair Credit Reporting Act, the Texas Finance Code, the Texas Business and Commerce Code, and the UEFJA, amongst others, allows us to assist clients in these areas and ensure compliance with such laws.
Further, we have excellent resources which allow us to efficiently locate a debtor (whether a business or individual), as well as locate their assets and bank accounts which may be used for collection purposes. These resources include Accurint, skip tracers, credit bureaus, public records databases, and other paid information sources.
